IDUF condemns recent criminal acts of rape and death in private drug de-addiction and rehabilitation centres in Kolkata and demands immediate closure

Subject – Recent Rape and Death of people with Substance Use Disorders in admitted to private Drug Deaddiction and Rehabilitation Centres in Kolkata


Greetings from Indian Drug Users’ Forum (IDUF) the voice of the drug using communities from across the country.

 IDUF is a not for profit organization, founded in August 2010 and legally registered in 2012.  IDUF is the national network of people who use drugs and we promote meaningful involvement of people who use drugs (MIPUD) in policy and programs that affect the lives of people who use drugs in India particularly Healthcare systems including HIV and AIDS, Viral Hepatitis, Tuberculosis and Treatment for Substance Use Disorders.

We take this opportunity to draw your kind attention to alarming news – a 15 year old girl undergoing treatment at a private drug deaddiction centre was raped and a man was beaten to death in another such centre in Kolkata during the last one month alone.IDUF condemns in strongest possible terms these criminal acts of human rights violations and we demand the culprits be punished to the full extent of the law.

 May 11, 2018 KOLKATA: [i]Rehab owner arrested for raping 15-year-old inmate. The rehab centre, Behala Suraksha Foundation, has been in operation for four years. Functioning out of a rented house in Muchipara, it is around 3km from the Tollygunge Metro station. May 9, 2018 KOLKATA:[ii] “A 43-year-old man was allegedly assaulted so brutally by a staff member of a rehabilitation centre at Sonarpur that he died early on Tuesday. Rajesh Choudhury, a resident of Kankulia in Ballygunge, was admitted to the rehabilitation centre, Jeevan Jyoti Foundation, last week to help him overcome his addiction to alcohol.”

 IDUF respectfully submits recommendation for immediate closure and regulation of all privately operated deaddiction centres that do not comply with the Mental Healthcare Act 2017[iii] of the Ministry of Health & Family Welfare, Government of India, the MINIMUM STANDARDS OF CARE IN THE FIELD OF ADDICTION TREATMENT/PREVENTION [iv]of the Ministry of Social Justice and Empowerment under the Scheme For Prevention of Alcoholism and Substance (drugs) Abuse and the Ministry of Health and Family Welfare, Government of India (Drug-De-addiction Programme-DDAP) Minimum Standards of Care For the Government De-Addiction Centres[v]. NGOs with a simple registration under the West Bengal Societies Registration Act, 1961[vi] must NOT be allowed to deliver specialised healthcare services for People with Substance Use Disorders in either outpatient or residential “treatment”.

 IDUF respectfully submits that these services are in violation of the rights to quality healthcare services, voluntary admission, and informed consent, protection from coercion, unlawful detention and sexual and physical abuse and such NGOs must be stopped. We further recommend that all healthcare services for people who use drugs and with Substance Use Disorders in the state of West Bengal be systematically regulated.

 IDUF respectfully submits reference to similar incidents in Delhi, the Health and Family Welfare Department, Government of NCT of Delhi in exercise of the powers conferred by Section 78 and sub-section(1) read with sub-section (2) of Section 71 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (Central act 61 of 1985), are currently in the process of systematically regulating all private deaddiction centres and have drafted the ‘DELHI SUBSTANCE USE DISORDER TREATMENT, COUNSELING AND REHABILITATION CENTRES RULES, 2018’[vii] by undertaking an inclusive process with all key stakeholders. 

 IDUF respectfully submits the aforementioned as an example of a way forward. We are very concerned and request the leadership of your good office to take urgent and necessary preventive measures so that such incidents in detoxification and rehabilitation centres are not repeated.

We stand committed to supporting any and all processes and procedures to help develop a framework for regulating these and other essential healthcare services for people using drugs and with Substance Use Disorders.

 We seek the protection and promotion of human rights above all and we look to the Health and Family Welfare Department, Government of West Bengal.
